Terms of Service

1. Acceptance of Terms
By creating an account or using Construction Radar (“the Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, do not use the Service. These Terms form a legally binding agreement between you and Construction Radar (“we”, “us”, “our”), a business operating in British Columbia, Canada.
2. Account Responsibilities
You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You must provide accurate registration information and keep it up to date. You may not share your account with others or allow unauthorized access to it. Notify us immediately at support@constructionradar.ca if you suspect unauthorized access.
3. Subscription & Billing
Pricing
Construction Radar is offered on a subscription basis at the following rates (all amounts in Canadian dollars, inclusive of applicable taxes where required):
- Monthly plan: $249.99 CAD per month
- Annual plan: $2,499.99 CAD per year (billed annually)
Auto-Renewal
Subscriptions renew automatically at the end of each billing period. You authorise us to charge your payment method on file via Stripe for the applicable subscription fee at the start of each renewal period. You will receive an email receipt for each charge.
Cancellation
You may cancel your subscription at any time through the billing portal accessible from your account settings. Cancellation takes effect at the end of the current paid period. You will retain full access to the Service until the period ends. We do not prorate or refund unused portions of a billing period. See our Refund Policy for details.
Price Changes
We reserve the right to change subscription prices. We will provide at least 30 days’ written notice before any price change takes effect. Continued use after the new price takes effect constitutes acceptance.
4. Acceptable Use
You agree not to:
- Scrape, crawl, or bulk-download data from the Service in an automated fashion without our written consent.
- Resell, sublicense, or redistribute the Service or its data to third parties.
- Use the Service to harass, stalk, or harm any individual.
- Attempt to circumvent security controls, access controls, or rate limits.
- Use the Service for any unlawful purpose or in violation of any applicable law or regulation.
- Reverse engineer, decompile, or disassemble any part of the Service.
We reserve the right to suspend or terminate accounts that violate these rules without refund.
5. Permit Data — “As Is” Disclaimer
The building-permit information displayed through Construction Radar is sourced from publicly available municipal and provincial records. This data is provided “as is” for informational purposes only. We make no warranty, express or implied, as to the accuracy, completeness, timeliness, or fitness for any particular purpose of permit data. Permit records may contain errors, may be delayed, or may have been amended since original publication. You are solely responsible for independently verifying any permit information before relying on it to make business decisions. Construction Radar is not responsible for any loss or damage arising from reliance on inaccurate or incomplete permit data.
6. Intellectual Property
The Construction Radar platform, including its software, design, and original content, is our proprietary property. You are granted a limited, non-exclusive, non-transferable licence to use the Service for your internal business purposes during your subscription period. Nothing in these Terms transfers any ownership of intellectual property to you.
7. Limitation of Liability
To the maximum extent permitted by applicable law, Construction Radar and its officers, employees, and contractors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, loss of data, or business interruption, arising out of or in connection with your use of (or inability to use) the Service, even if advised of the possibility of such damages.
Our total aggregate liability to you for any claims arising under these Terms shall not exceed the amount you paid to us in the three months preceding the claim.
8. Disclaimer of Warranties
The Service is provided “as is” and “as available” without warranties of any kind, whether express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
9. Termination
Either party may terminate the Service relationship at any time. We may suspend or terminate your access immediately for a material breach of these Terms. Upon termination, your right to use the Service ceases. Provisions that by their nature should survive termination (including Sections 5, 7, 8, and 10) will survive.
10. Governing Law & Disputes
These Terms and any dispute arising out of or in connection with them shall be governed by and construed in accordance with the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict of law principles. You agree to submit to the exclusive jurisdiction of the courts located in British Columbia, Canada for the resolution of any dispute.
11. Changes to These Terms
We may update these Terms from time to time. Material changes will be communicated by email or in-app notice at least 14 days before taking effect. Continued use of the Service after the effective date constitutes your acceptance of the revised Terms.
